1. RESPONSIBLE PARTY:
The reservation is required to be made by an individual of at least 25 years of age unless he/she is an active member of the military. The Property is considered a family vacation rental, and therefore, each individual under the age of 25 must be accompanied by a parent or legal guardian who must also reside at the Property throughout the duration of the stay. Reservations obtained under false pretenses will cause forfeiture of all payments, and Guest will be asked to vacate the Property immediately. This policy includes reservations made by parents who do not check-in and/or who leave overnight during the length of the stay. NO EXCEPTIONS!
2. RENTS AND PAYMENT:
25% is due at the time of booking. Reservations made via a third party booking vendor may incur additional fees. Please refer to the terms and conditions on their website. No reservation will be confirmed until the deposit is received. This agreement must be signed within 48 hours of making the reservation. By making a reservation and paying the deposit, you are confirming and accepting the reservation. Payment of reservation deposit is considered to be acceptance of cancellation terms regardless of the signature status of the reservation confirmation.
- Payment of the remaining balance is due no later than 30 days from the earliest date in the Rental Period.
- For reservations made less than 30 days from the Period, 100% of the balance is due upon booking.
- For reservations longer than 28 days (long-term reservations), the remaining balance is due no later than 60 days from the earliest date in the Rental Period.
- Accepted forms of payment are Visa, MasterCard, Discover, bank money order, cashier's check or personal check. Initial payment must be made with a credit card, and Guest agrees to provide SeaBreeze with a valid credit card in his or her name to secure any expenses incurred under this Agreement and agrees that should Guest fail to make payment in full or cancel the reservation by the due date, SeaBreeze is authorized to charge any amounts owed to Guest’s credit card.
Rental rates are subject to change, and no refunds will be provided in the event that the advertised rental rates are reduced subsequent to Guest’s booking. If a discrepancy arises between information or rates quoted verbally, on SeaBreezevacation.com or any site where the Property is advertised, via email or otherwise, the rate on the reservation will prevail. In the event incorrect information or rates are quoted due to a typographical or other error, SeaBreeze shall have the right to refuse, cancel, or limit any reservations listed incorrectly, whether or not a reservation confirmation has been sent.
The Guest, upon making the reservation, will be required to complete an online identity verification. Guests receive the online link to a Guest Verification Website with their reservation confirmation. Providing the proper documentation, including a copy of your ID, avoids any fraudulent reservations. Guests that have stayed in a SeaBreeze Property in the past do not need to complete the online identity verification. This identity verification must be completed within 48 hours of making the reservation.
If Guest is renting from a managed HOA facility, there may be a HOA application requirement. Please refer to the property listing when making your reservation. Any HOA Applications must be completed within 48 hours of making the reservation.
3. INSPECTION AND TERMINATION:
SeaBreeze has the right to inspect the Property without prior notice at any time to enforce the terms of this Agreement. Should Guest or any Guests of Guest violate the terms of this Agreement, then SeaBreeze may terminate Guest’s occupancy, and Guest will forfeit any monies paid to SeaBreeze and may be subject to additional fees which Guest authorizes to be charged to the credit card “held on file” for the reservation.
Guest agrees to vacate the Property at the conclusion of the Rental Period and agrees that a refusal to do so will constitute trespassing and subject Guest and his or her invitees to possible criminal charges. SeaBreeze or its agent may enter the Property and remove Guest, the members of Guest's party, and their belongings.
4. SECURITY DEPOSIT WAIVER FEE:
Each reservation includes a Security deposit Waiver Fee which is non-refundable for all reservations. This pays for accidental damage to the Property during your stay. This does not pay for wanton acts, theft or malicious damage. All accidents must be reported to SeaBreeze prior to check-out. Guest takes full responsibility for invitees and any charges in full for any and all damage over $2,000 caused. Guest authorized that the cost for all non accidental damages, theft or malicious damage to be charged to the credit card “held on file” for the reservation. {{initial}}
5. CLEANING FEE:
Property will be cleaned to quality standards prior to your arrival and after your departure. You will be responsible for the cleaning of the Property during your stay and for leaving the Property in good condition at check-out. A mid-stay clean and charge equal to the standard cleaning fee are required for all stays 15 nights or longer. Each Property has a cleaning fee associated with the size and amenities at the Property. The mid-stay cleaning fee is included in “Required Fees” when making your reservations. SeaBreeze respectfully requests that you remember that you are staying in someone’s home during your vacation. Please treat the Property with the care you would your own. Excessive cleaning required by the cleaning staff subsequent to check-out will result in a charge to the credit card on file.
6. TAXES:
Taxes are required to be collected on rentals in duration of six months or less and are calculated in the reservation amount subject to the State of Florida Sales Tax and Manatee County Resort Tax.
7. CHECK-IN /CHECK-OUT:
Guest must complete all required documentation prior to check-in. Failure to do so may result in delayed check-in.
Scheduled check-in time starts at 4 p.m. on the first date of the Rental Period. Due to the cleaning practices and unforeseen circumstances, the Property may not be ready upon your arrival. We apologize in advance if you experience a delay in check-in time. However, we want to ensure each Guest a quality stay.
You will receive your access code, etc. at least 24 hours before check-in via text and or Email. Check-in/Check-out details will also be sent via email. Check-out time is prior to 10 a.m. on the last day of the Rental Period Early Check-in or late Check-out may be requested but not guaranteed. Rate adjustments can not be made for late check-in or early departure.
8. PROPERTY ACCESS:
Most properties managed by SeaBreeze utilize the latest electronic locking technology. No keys are provided for that Property. Access codes will be sent via text message to the Guest. This is also available in the mobile Guest app. There are a number of properties that have a traditional key access. Be sure to review your check-in instructions to verify if keys need to be picked up.
If the Property Guest is renting has traditional keys or key FOB access, Guest may need to stop by the SeaBreeze Office at 5372 Gulf Drive, Holmes Beach to pick them up. Failure to return the keys or key FOB due to loss or damage will result in a fee. Please refer to your check-in instructions prior to arrival.
9. HURRICANE, TROPICAL STORMS, AND ACTS OF GOD:
SeaBreeze cannot be held responsible for inclement weather or any Acts of God and, refund of rental monies will not be given. Should a hurricane or tropical storm threaten our area, we will receive evacuation instructions from the National Hurricane Center and our local governing officials. Only if the “Mandatory Evacuation” order is issued, full or prorated refunds will be given.
10. DOG POLICY:
A select number of properties managed by SeaBreeze will allow small house-trained dogs aged over 1 year. Some properties do not allow dogs under any circumstances. All dogs must be authorized prior to arrival. An additional fee of $250 plus taxes per dog per reservation will be charged. In the event that a Guest brings a dog to a dog-friendly Property without obtaining prior authorization, a $500 surcharge on the total cost of the reservation will be charged to the Guest’s credit card, and SeaBreeze also reserves the right to terminate this Agreement immediately without refund. In the event that a Guest brings a dog to a non dog-friendly Property, a $1,200 surcharge will be charged to the Guest’s credit card, and SeaBreeze also reserves the right to terminate this Agreement immediately without refund.
The following strict rules apply to properties that do allow dogs:
- Only well-behaved and housebroken DOGS are allowed! Cats or other pets are not approved!
- Only certain breeds of dogs are allowed and must be approved before check-in.
- Our pet-friendly properties restrictions are listed on each pet-friendly property.
- Approved dogs must weigh less than 30 lbs. Any dog weighing more than 30 lbs is NOT permitted!
- You must notify SeaBreeze if you are traveling with a dog. A $250 non-refundable pet fee is required per dog. If an unauthorized dog is found during the stay, Guest is subject to immediate eviction with no refund of monies paid and will be responsible for damages as well as extra cleaning fees.
- Guest will be responsible for any damages as well as additional cleaning or treatment needed due to fleas, “accidents”, or excessive pet hair. Guest to clean all excess dog(s) hair and remove from the inside of the unit prior to departure.
- Guest is solely responsible for any damage or personal injury caused by dog(s).
- Guest agrees to always keep their dog(s) under control.
- Guest agrees to promptly report any damage caused by their dog(s).
- Guest agrees to pay any costs for damage done by their dog(s) which exceeds the pet fee per dog(s) or is not covered under an additional damage insurance policy.
- If damages are not reported but are found by SeaBreeze, a charge will be incurred on Guest’s credit card on file.
- Dog(s) are strictly not allowed on the beds or sofas or in the pool or spas.
- All dogs must be up to date on rabies and all other vaccinations.
- Guest agrees to adhere to local ordinances, leash laws and licensing requirements. Dogs are NOT allowed on the beaches of Anna Maria Island.
- Guest agrees to clean up after their dog(s) and dispose of their dog(s) waste promptly. Any clean-up of dog refuse outside by SeaBreeze Maintenance will result in a $150 fee charged to your credit card on file.
- Guest agrees to review and repair any yard damage created by their dog(s) such as but not limited to digging.
- Guest agrees to keep dog(s) from being noisy or aggressive and from causing any annoyance or discomfort to others. Guest will remedy any complaints immediately. Guest acknowledges local ordinance noise restrictions and excessive noise by a dog(s) may result in fines from the local municipality. Guest is responsible for said fines.
- NO personal pet beds or other such items should be put in the washer or dryer.
- Repairs for rescreening if your dog(s) breaks through the porch screen for any reason will be assessed at labor charges.
- “Vicious or dangerous dogs” trained for dog fighting or with any tendency or disposition to attack other domestic animals or humans without provocation are not permitted at any time. Any dog with a recorded bit history is strictly prohibited.
- Guest agrees the dog(s) will be crated when Guest is not on the Property.
11. SMOKING:
All properties managed by SeaBreeze are considered Non-Smoking. This includes but not limited to all tobacco products, hookahs, vapes, cannabis, etc. Guests may smoke outside of the residences with the doors closed to reduce the risk of smoke within the residence. Balconies (both screened and unscreened) and garages are considered non-smoking areas. Please refer to Property descriptions as some condo associations have a smoke-free policy for all parts of their Property. Guests will incur an additional charge of $500 for cleaning and deodorizing if any evidence of smoking is found on the Property. If tampering with smoke detectors is found, a charge of $150 will be incurred.
12. FURNISHINGS & HOME DECOR:
The furnishings and decor provided have been properly placed to create a comfortable island vacation for you and your family. All items are accounted for and documented prior to your arrival and should be returned to their original location if moved during your stay to avoid any additional service charges of up to $250. Wear and tear as well as correctional spot clean is to be expected in a rental home.
13. OCCUPANCY:
Each Property includes a stated limitation on the number of overnight Guests which the Property can accommodate. No exceptions will be made to this stated capacity. Should more individuals than allowed be found to be staying at the Property, then Guests will be asked to vacate the Property and no refund will be given.
14. QUIET USE AND ENJOYMENT:
SeaBreeze does not guarantee quiet use or enjoyment of rental properties due to noise from other persons, neighboring properties, construction, maintenance, etc. SeaBreeze can not grant rate adjustments resulting from circumstances outside of the Property. There are local noise ordinances which do not allow music, vocal noise or disturbances from 10 p.m. - 8 a.m. Details can be found in each Property and on our mobile Guest app.
15. NEIGHBOR POLICY, DISTURBANCES, PARTIES, AND OTHER LARGE GATHERINGS:
Properties are located in residential neighborhoods with annual residents. Guest and Guests shall comply with all applicable laws and rules of homeowners or condominium associations and shall be good neighbors, respecting the rights of the surrounding neighbors, and shall not create noise or disturbances that interfere with the quiet enjoyment of their neighbors Property. Please be sure to observe all rules and regulations of the local municipality in which you are located. A summary is provided for you within the Property and through our mobile Guest app. These municipality regulations, including the noise ordinance, are enforced by local enforcement.
All Guests, as well as owners, are required to conform to all rules and regulations of the properties. Please respect the rights and space of your neighbors and neighborhood.
SeaBreeze is not responsible and will not issue a refund due to construction work occurring at the Property or near your rental. SeaBreeze is not responsible to notify Guest of pending construction nearby Property. Construction and scheduling of construction is out of SeaBreeze’s control. Construction noise is permitted 7 a.m. - 7 p.m. Please call SeaBreeze about any construction noise outside of the permitted hours.
Noise disturbances, parties and other large gatherings in excess of__ people or use of common areas in a manner contrary to the provisions of this Agreement or the rules of any applicable homeowners or condominium associations, are strictly prohibited. Guests shall be responsible for any fine, penalty or assessment which may be imposed by reason of violation of this Agreement. IF NOISE COMPLAINTS, OVER OCCUPANCY, OR CONTRACT VIOLATIONS OCCUR, OR LAW ENFORCEMENT IS DISPATCHED TO PROPERTY DUE TO ANY DISTURBANCES OR ILLEGAL ACTIVITY, Guest AND ALL OCCUPANTS ARE SUBJECT TO IMMEDIATE EVICTION BY SEABREEZE WITHOUT REFUND.
16. PARKING:
Each vacation rental can accommodate the number of vehicles shown on the Property listing. Should a Guest have visitors, their Guests are subject to the same vehicle limitation at the Property. Street parking is allowed in certain locations subject to local ordinances and should be considered daily parking for visitors only. No boats, motor homes, trailers, commercial vehicles, etc., shall be permitted on the Property. Please refer to the Property description for what vehicles are allowed.
17. POOLS AND SPAS:
Properties with heated pools and spas are heated to approximately 82 degrees. When the ambient temperature falls below 65 degrees for more than 5 hours, the pool heater may not function and even switch off. On days when the weather is cool, the pool heaters may not be able to accommodate swimming. Temperature recovery times will vary due to the outdoor temperature. Pool heaters operate ONLY when the pool pump is running. Residential pool pumps do not run overnight, but typically run 6-8 hours per day during the hours of 8 a.m. - 10 p.m. SeaBreeze is not responsible for the temperature of the pool due to weather and cannot provide compensation for any such events. Pool service is valued at $25 per day - refunds are prorated if the pool equipment malfunctions or is inoperable.
Pools are exposed to direct sunlight; therefore, the temperature of the pool will be warmer than normal if the heat index is high. SeaBreeze has no control over cooling the temperature of the pool.
If the Property is equipped with a spa, these are not hot tubs and the water temperature is not heated as it would in a standalone hot tub. Special risks may be involved when using a pool, spa, deck, related equipment, and/or barbecue area (collectively, the “Facilities).
SeaBreeze has no control over condominium pools and spas. If the pool is inoperable, SeaBreeze will try and rectify the issue with the property management at the condominium or the HOA; however, we do not provide refunds if the pool is unusable.
If the Property is equipped with Facilities, Guest acknowledges, on behalf of himself/herself and his or her Guests and invitees, the following:
- Guest adheres to the Water Watcher Program. SeaBreeze is a participant in the National Public Education Campaign, Pool Safely, to help reduce child drownings, non-fatal submersion and entrapments in swimming pools and spas. Water Watcher Program safety tips and lanyard tag provided in the Property.
- Guest shall ensure that the Facilities are used in a safe manner at all times and that non-adult use of the Facilities, permitted, is supervised by a qualified and capable adult.
- Unsafe and/or unsupervised use of the Facilities by Guest or Guest’s visitors is a material breach of this contract and shall permit SeaBreeze to terminate IMMEDIATELY WITHOUT NOTICE Guest’s occupancy of the Property.
- Guest shall ensure that the Facilities including a pool alarm are in proper working condition upon arrival. Guests are prohibited to tamper with chemicals or equipment. If a Guest is found to have tampered with chemicals or equipment, the Guest will be responsible for any expenses incurred.
- Guest shall indemnify and hold the owner of the Property, SeaBreeze, its officers, owners, licensees, contractors, vendors, subcontractors, employees, and agents harmless from and against any and all liabilities, claims and expenses for personal injury including death or Property damage resulting from the Facilities.
Most properties are equipped with propane barbecue grills plus a spare propane tank. Guest is responsible for providing charcoal for any outdoor barbecues provided unless specified in the Property description. There are some Properties that do not permit barbecue grills. Please check with the property description when making your reservations.
19. GOLF CARTS:
For a limited time, certain properties have a golf cart included. Please see the SeaBreeze Vacation website for those properties and dates. If your reservation does include a golf cart, you will receive a separate confirmation in your email within 48 hours as well as a Carts Agreement. These carts are offered to you at no additional cost. SeaBreeze golf carts are high-quality street legal that can accommodate six passengers. You need to be a U.S. licensed driver, have auto insurance and be over 21 years old to drive. There are no refunds if you can not provide a driver’s license or a copy of your auto insurance policy. Should the golf cart become inoperable, SeaBreeze will try and rectify the issue. Guests will receive a prorated refund if the golf cart is inoperable. SeaBreeze golf carts are valued at $35 per day. Guest is responsible for any damage to the vehicle. See SeaBreeze Carts Agreement for additional information and signature.
20. PROPERTIES FOR SALE:
SeaBreeze reserves the right to allow licensed realtors to show the Property. There are instances where the properties are for sale and from time to time it is necessary for realtors to show these properties to potential buyers. If this circumstance arises, we require the realtor to give us a 24-hour notice so we may inform Guest of this interruption.
21. MAINTENANCE:
The Properties are regularly maintained to ensure the quality of your vacation rental Property. During your stay, regular maintenance will be performed throughout the week which may include landscaping, lawn care, pool cleaning, etc. In the event of a mechanical failure at the Property, please contact SeaBreeze as soon as possible so we can quickly schedule a repair. No rent adjustments can be made for circumstances beyond our control or for malfunction or loss of use of equipment on Property. SeaBreeze reserves the right to have employees, vendors, contractors or subcontractors access to the rental Property to make necessary repairs or improvements in the management of the Property.
22. INDEMNITY:
Guest, inclusive of Guest’s party and minors of Guest, willingly accepts and assumes all risk of personal injury, death, and Property damage which results from using and occupying the Property and amenities. Guests agree and acknowledge to use said amenities for their intended purposes only. Guest and Guest’s party waives any and all possible claims for liability and damages against the Owner(s) of the Property and holds Owner and SeaBreeze harmless of claims arising out of or in connection with or related to gross negligence or willful misconduct of Guest and Guest Parties. Guest will take full fiscal responsibility if Guest’s party does not release indemnify and hold SeaBreeze and Owner(s) harmless and/or any damages, injuries or death occurs.
23. COMMUNICATION POLICY:
Information collected at the time of reservation (email, physical address, phone number(s), name) will only be used to contact you regarding that reservation with the exception of your email and physical address. Your email and physical address will be used to send periodic newsletters, promotions, and other information pertaining to SeaBreeze. At any time, you may unsubscribe from these communications using the link at the bottom of the emails or contacting us directly. Personal information collected at the time of reservation will not be shared or sold for any circumstance.
24. DISCLAIMER:
SeaBreeze reserves the right to relocate a Guest to an alternate Property of similar or better quality and location for whatever reason. If Guest disagrees with the relocation, SeaBreeze will cancel reservation and will refund the rental cost in full. SeaBreeze, at times, may record telephone calls for training and quality assurance purposes. SeaBreeze takes zero responsibility for stolen personal items in the rare case of theft or vandalism. Guest acknowledges that SeaBreeze is the agent of the Property Owner and will be paid by the owner. All monies may be placed in an interest-bearing bank account with interest payable to agent. Guest acknowledges that this written notice was given, and is understood, prior to entering into Rental Agreement, in compliance with all Florida Statutes. Receipt of initial payment from Guest to SeaBreeze constitutes acceptance of all terms and conditions.
25. MISCELLANEOUS:
A signature via electronic transmission or electronic signature hereon shall be deemed an original. Time is of the essence of this Agreement. SeaBreeze may promulgate reasonable rules and regulations which shall automatically deemed to be part of this Agreement upon delivery of the same to Guest. Assignment of this Agreement by Guest is prohibited.

Each Property is privately owned, and each Owner is responsible for choosing the TV service. SeaBreeze is not responsible for the service or channels at the Property. All SeaBreeze Properties have high-speed internet. SeaBreeze is not responsible for any service disruptions.
26. TRAVEL PROTECTION INSURANCE:
SeaBreeze has partnered with Red Sky Travel Insurance to provide Sun Trip Preserver® coverage for our Guests. Sun Trip Preserver provides cancellation and interruption services as well as emergency assistance and travel services. Protect yourself in the event of hurricane evacuations and family emergencies such as illness or death in the family. The travel insurance is optional, but highly recommended, and the cost is 6.95% of your total reservation stay. Lock your policy in early, for the most coverage it is strongly recommended you purchase with your first booking deposit. Premium is non-refundable after 14 days of purchase. 27. CANCELLATION:
Rental costs, as well as other protected non-rental fees will be refunded as follows under our cancellation guidelines:
Cancellation Policy for Reservations with trip cost less than $20,000 or a length of less than 28 days:
- Reservations are NOT canceled until SeaBreeze receives written notification via email of the cancellation. All written cancellation notifications are contingent on SeaBreeze receiving the email based on the date/time (EST - Eastern Standard Time).
- There is a 48-hour grace cancellation period for reservations made 21 days or more in advance. Please note that if reservations were made via a 3rd party booking vendor, fees may not be refunded. Refer to the terms and conditions on their website.
- Reservations canceled between time of booking and 35 days before scheduled check-in: 5% fee of the total cost of the reservation or $100 whichever is greater.
- Reservations canceled 34-14 days before scheduled check-in: 25% fee of the total cost of the reservation or $500 whichever is greater.
- Reservations canceled less than 14 days prior to scheduled check-in: NO refund or credit given for any reason.
- Excluded items from the refund include, third party booking fees and travel insurance. Refund Payments for canceled bookings made before check in date will be released back to the canceling Guest within 5 days of cancellation. Guests may cancel their reservation by notifying SeaBreeze in writing that they wish to cancel.
- Refund Payments for canceled bookings made before check-in date will be released back to the canceling Guest within 5 days of cancellation.
- Once you are checked-in, there are no refunds for any reason including early departures, delayed arrivals, Acts of God including but not limited to hurricanes and tropical storms, reduction in the number of nights reserved, Red Tide, etc. Only exception regarding refunds would be mandatory evacuations. Full refunds are given if Guest has not checked in and there is a mandatory evacuation. Prorated refunds are given ONLY if there is a mandatory evacuation during Guest stay.
- Excluded Reservations: Reservation made 14 days or less from the check-in date. Reservations made using a credit from a previously canceled reservation will not be covered. The maximum trip cost reimbursement is $20,000 USD. Bookings with a trip costing more than $20,000 USD or a length of more than 28 days do not qualify for the Flexible Cancellation policy.
- Reservations are NOT canceled until SeaBreeze receives written notification via email of the cancellation. All written cancellation notifications are contingent on SeaBreeze receiving the email based on the date/time (EST - Eastern Standard Time).
- Bookings with trip cost over $20,000 or a length of more than 28 days will need to purchase optional travel protection for coverage benefits. Reservations of more than 28 days and a cost of over $20,000 must be paid in full no later than 28 days prior to scheduled check-in. If full payment is not received 28 days prior to check-in your reservation will be canceled and no refund will be given.
- There is a 48-hour grace cancellation period for reservations made 60 days or more in advance. Please note that if reservations were made via a third party booking vendor, fees may not be refunded. Refer to the terms and conditions on their website.
- Refund payments for canceled bookings made before the scheduled check-in date will be released back to the canceling Guest within 5 days of cancellation.
- Once you are checked-in, there are no refunds for any reason including early departures, delayed arrivals, Acts of God including but not limited to hurricanes and tropical storms, reduction in the number of nights reserved, Red Tide, etc. Only exception regarding refunds would be mandatory evacuations. Full refunds are given if the Guest has not checked in and there is a mandatory evacuation. Prorated refunds are given ONLY if there is a mandatory evacuation during Guest stay.
- Excluded Reservations: Reservation made 60 days or less from the scheduled check-in date. Reservations made using a credit from a previously canceled reservation will not be covered.
- Refunds will not be given for any reason once final payment is made. Reservations canceled prior to 60 days before scheduled check-in will be refunded less a 5% cancellation fee.
- Excluded items from the refund include third party booking fees and travel insurance.
